Property division is governed at a provincial level. The federal divorce act does not have provisions for property or debt at the time of a marriage breakdown.
Each province sets out the laws for the division of property and liability in their respective acts. Some, but not all regions, have common law legislation.
Matters of guardianship reside in both parts of the federal law and provincial law. Regardless of what province you are in, you must demonstrate that custody and child support have been dealt with before you will be granted a divorce.
Spousal support, also referred to as alimony or maintenance, is the legal obligation for one person to provide an ex-spouse financial support after a marital breakdown or separation.
Many factors and calculations affect the amount, or whether or not an ex-spouse is even entitled to spousal support payments.
“Child support” is the money that one parent pays to another to support their children financially after a separation or divorce.
It is a monthly payment for the benefit of dependent children.
